Identifying, Protecting & Profiting from Intellectual Properties

We are often asked to assist our business clients in identifying and protecting their most valuable intellectual properties. By identifying and protecting such properties at early stages of development, competitive advantages can be maintained, liabilities can be avoided, and shareholder returns on investment can be maximized. Many companies have found it profitable to develop active portfolios of intellectual properties that can be licensed to other companies and organizations.

To achieve these results, however, it is important to identify and protect internally developed intellectual properties from the earliest stages of development. It is important that uniform policies and procedures be adopted at the corporate level for the identification and preservation of developmental efforts. Some companies even provide additional compensation or award programs to encourage employees to promptly submit ideas and developments to the company.

In order to support such policies, however, it is important that all staff (management, technical, and support staff) execute appropriate restrictive agreements placing title to their work-related developments in the corporation. It is also important that all staff become aware of the forms of legal protection available to the company, as well as the company's policies with regard to identification, documentation, and protection of its intellectual properties.
